Baby and Toddler Gate
Defects and Dangers |
|
| Defective baby gates can
pose safety risks, including death, to young children
who get through the gateway and gain access to
stairs, other dangers from falling, or otherwise
dangerous and protected areas. Injuries have also
been reported due to poorly secured gates, gates
that could be climbed, pushed out of place, or
opened by children. |
| In October 2001, Evenflo
Company Inc., of Vandalia, Ohio, recalled about
20,500 Home Décor Swing wooden baby
gates. The plastic mounting hardware that attached
to the wall reportedly was subject to cracking
or breaking, allowing the wooden gate to unlatch.
Children could then gain access to restricted
areas, such as stairs. |

|
|
| In June 1999, North States
Industries Inc., of Minneapolis, Minnesota, recalled
about 3,200 stairway gates. The reason for the
recall was that the locking mechanism could release
when the gate was shaken. If the gate was placed
at the top of the stairs, a child release the gate
and fall down the stairs. |
| The law in most states provides individuals with legal
claims and the right to compensation for injuries they suffer as a result
of a defective product or the negligence of another. The injured person
may file a lawsuit seeking compensation for his or her pain and suffering,
medical expenses, lost past and future wages and punitive damages. |
