Crocs Shoes Lawsuit: Child Injuries on Escalators

Multiple lawsuits have been filed across the nation against Crocs Inc. alleging children have suffered maimed and disfigured foot injuries on escalators. The complaints allege the soft sole shoes tend to stick to escalator steps, dragging the child's foot into the mechanism and causing severe injuries.

For example, three children were severely injured in a three month period at the Atlanta airport, leading officials to post signs warning of escalator dangers. Injuries have reported at other airports across the county. In April 2008, Japanese and Filipino authorities asked Crocs to consider changing the footwear's design because of similar escalator accidents in their countries.

The U.S. Consumer Product Safety Commission has documented 77 soft shoe entrapments on escalators since January 2006 and issued a warning in May. In response, Crocs stated it was aware of 186 accidents involving its shoes and has initiated "safety investigations." Crocs, however, denied that its shoes present any safety hazard on escalators.

Consumer Products Safety Commission Warning on Crocs

In May of 2008, the U.S. Consumer Products Safety Commission issued a safety warning relating to children and escalators and "soft-side shoe entrapment" dangers. Read a copy of this CPSC warning document.

Legal Rights of the Injured

The law in most states provides individuals with legal claims and the right to compensation for injuries they suffer as a result of a defective product or the negligence of another. Parents of injured children may file a lawsuit seeking compensation for pain and suffering, medical expenses and punitive damages.
