MagnaMan Magnetic Toys and Injuries from Children Swallowing Magnets
MagnaMan magnetic toys are action figures that have various body parts that are attached with magnets. There are two themes: "Futuristic Warrior" and "Ancient Warrior." Over 1 million of these toys were sold nationwide.
On March 17, 2008, the U.S. Consumer Product Safety Commission (CPSC) announced that MEGA Brands America Inc., formerly Rose Art Industries Inc., was recalling these products. Consumers were advised to stop using the products immediately. The specific MagnaMan toys that were recalled are:
- Alien 28170
- Robotor 28171
- Flame 28172
- Gigantor 28173
- Toyoto the Samurai 28164
- Sir Lancelot the Knight 28165
- Eric the Viking 28166
- Brutus the Gladiator 28167
- Robot Assortment 28198
- Vac Metal 28327
- 4-Pack 28175
- 3-Pack 29393
- 2-Pack 28327
- Vac Metal Assortment 28327
- Assortment 28254 or 28199
Embedded magnets in children's toys can detach over time. When more than one magnet is swallowed or aspirated by a young child, the powerful magnets attract to one another, causing intestinal perforations and blockages, which can be fatal. The CPSC had received 25 reports of magnets coming loose.
Millions of Defective Magnet Toys Remain Accessible to Children
In June, 2007, the CPSC sponsored a forum on magnet ingestion, during which it was determined that magnet ingestion is likely to be a growing problem since age-weakened plastic causes the magnets to loosen more easily.
The CPSC does not release specific data pertaining to recall response rates. It is believed, however, that millions of recalled child magnets toy sets have not been turned in and remain in the hands of children.
Legal Rights of the Injured
The law in most states provides individuals with legal claims and the right to compensation for injuries they suffer as a result of a defective product or the negligence of another. The injured person may file a lawsuit seeking compensation for his or her pain and suffering, medical expenses, lost past and future wages and punitive damages.
