Powdered Baby Formula and Brain Infection:
The Link Explained |
|
| The use of powdered infant
formula can lead to severe brain infections, known
as E. Sakazakii infections, in premature babies,
low birth weight babies and babies with suppressed
immune systems. The infected infants infants suffer
severe and permanent brain damage, necrotizing
colitis and in some cases die. |
| The reason
why these infections develop is that powdered
infant formulas are not commercially sterile
products. Bacteria and other contaminants can
exist in powdered infant formulas that cause
infections in premature babies and infants
with compromised immune systems. |
| Scientific
articles about E. Sakazakii infections began
appearing in the late 1980s. In April, 2002,
the Center for Disease Control published a
report of one infant death and several infections
at a Tennessee hospital caused by E. Sakazakii contamination in powdered formula. |

|
| The same month, the Food
and Drug Administration sent a "Dear Health
Care Professionals" letter to hospitals and
doctors to inform them about "a growing body
of information pertaining to E. Sakazakii infections
in neonates fed milk-based powdered infant formulas." To
date, the FDA has not taken any regulatory action
on the use of powered infant formula, other than
to continue to study the matter. |
| Parents of premature babies,
low birth weight babies and babies with suppressed
immune systems should not feed their babies powdered
formula. Instead, if breast feeding is not an option
or must be supplemented, use liquid formula. It
is a sterile product. |
| The law in most states
provides several personal injury claims for persons
who have been seriously injured by products intended
for human consumption. The infant formula manufacturers
owe a duty to parents to provide sterile products
that pose no risk to babies. |
| In contaminated infant
formula lawsuits against Nestle, Abbot Laboratories
and other infant formula manufactures, parents
represented by Lieff Cabraser have sought recoveries
on behalf of their injured children for: |
- Physical pain and suffering,
mental anguish and physical impairment;
- Past medical expenses and anticipated future
medical expenses, nursing care and specialized
health and educational services and other life
care expenses;
- loss of earning capacity;
- and loss of enjoyment of life;
- as well as damages for the severe emotional
distress the parents have suffered.
|
| In the case of a baby
that dies, a wrongful death suit may be filed by
the family. |

of a defective product or the negligence of another. The injured person
