Dangerous Defective
Trampolines |
|
| A US Consumer Product
Safety Commission estimates that over 80,000 patients
receive treatment for trampoline injuries each
year, and the majority of these patients are under
15 years of age. |
| A new study of emergency
room visits conducted in the U.S. reports that
injuries caused by backyard trampolines have nearly
doubled in the past decade from 42,000 in 1994
and 1995 to 75,000 in 2001 and 2002 (the most recent
years with complete data). This information was
recently presented at the annual meeting of the
Pediatric Academic Societies. |
| James
Linakis, a pediatric emergency physician at
the Rhode Island Hospital's Hasbro Children's
Hospital and an associate professor of emergency
medicine and pediatrics at Brown Medical School,
stated, "Trampolines should not be used
in the home environment." Trampolines
should "be used in very structured, well-monitored
environments, with proper supervision," Linakis
added. |
| Serious
injuries from trampolines, such as spinal injuries,
bone fractures, dislocated joints and severe
cuts that require hospitalization are on the
rise. While some versions of trampolines are
ringed by nets designed to keep children from
falling off, many do not have safety precautions
to prevent injury, even during proper usage
of the device. |

|
| Manufacturers often fail
to warn users of the potential risks of trampolines,
applying warning labels that are often inadequate
and poorly placed. In a case involving a product
manufactured by AMF called a mini-trampo-line ("mini-tramp"),
plaintiff Lauren Pell, a 16-year-old sophomore
and beginner gymnast, severed her spine and was
permanently paralyzed as a result of a defect in
the mini-tramp. She was subsequently awarded $5
million for her spinal injury. |
| The law in most states
provides individuals with legal claims and the
right to compensation for injuries they suffer
as a result of a defective product or the negligence
of another. The injured person may file a lawsuit
seeking compensation for his or her pain and suffering,
medical expenses, lost past and future wages and
punitive damages. |
