| Garage Door Defects
and Safety Issues |
|
| According to a 2003 report
by Consumer Product Safety Commission (CPSC), there
were 62 deaths and 49 injuries to children under
15 years of age associated with automatic garage
doors between March 1982 and November 1996. Broken
springs, failed reverse mechanisms, and sensor
problems are the primary causes of child entrapment
by garage doors. |
- In May 1997 the Chamberlain Group Inc.
announced a recall to inspect and repair
about 6,000 Sears Craftsman garage door
openers used on swinging or sliding garage
doors in Puerto Rico. The garage doors
reportedly were not installed by a Sears
authorized installer, and therefore the
garage door openers' safety reversal system
may not have operated properly, posing
a potential entrapment hazard. A 4-year-old
boy died from being caught in a swinging
door operated by a Sears Craftsman garage
door opener when the safety reversing sensor
did not operate.

| The law in most states provides individuals with legal
claims and the right to compensation for injuries they suffer as a result
of a defective product or the negligence of another. The injured person
may file a lawsuit seeking compensation for his or her pain and suffering,
medical expenses, lost past and future wages and punitive damages. |
