Patient Deaths Linked to Byetta Diabetes Drug

In August 2008, the U.S. Food and Drug Administration announced that stronger warnings will be added to the label of Byetta after reports of two deaths linked to the injectable diabetes medication. The FDA earlier received reports of multiple cases of acute pancreatitis, which can lead to bleeding and death, in patients taking Byetta (or exenatide, the drug's generic name).

Amylin Pharmaceuticals Inc. manufacturers Byetta, which is given by injection twice a day to adults with Type 2 diabetes. Patients have filed personal injury lawsuits against Amylin, the drug's co-marketer, Eli Lilly and Co., for allegedly failing to adequately test and monitor the side effects of Byetta and failing to warn doctors or patients of the risk of developing pancreatitis.

Legal Rights of Injured Byetta Patients

The law in most states provides several personal injury claims for persons who have been seriously injured by a prescription drug with dangerous, undisclosed side effects. These claims include strict liability for a defective product, breach of warranty, negligence, and misrepresentation. Damages sought against pharmaceutical companies for drug side effects and injuries include:

  • Physical pain and suffering, mental anguish and physical impairment;
  • Medical expenses associated with efforts to remedy the injuries as a result of the original surgery; and
  • Loss of earnings and/or earning capacity.

In the case of a patient's death, the family of the victim may file a wrongful death action and seek damages.
