Fosamax and Link
to Jawbone Decay and Osteonecrosis of the Jaw |
|
| Fosamax (alendronate
sodium) is part of the class of drugs called
bisphosphonates, and is the most-prescribed
medicine for osteoporosis in post-menopausal
women. It is manufactured by Merck & Co.
and has been on the market since 1995. |
| Patients have charged
that Merck misrepresented the safety of its
osteoporosis drug Fosamax by withholding warnings
that it could kill jawbone tissue. Fosamax
has been linked to osteonecrosis of the jaw,
or ONJ. |
|
|
|
| ONJ occurs when the blood
supply to the jaw bone is restricted. ONJ is a
disfiguring condition that leads to breakdown of
the jawbone and loss of teeth. ONJ can have a devastating
impact on patients, causing severe weight loss,
home confinement, loss of employment and leave
patients susceptible to mouth infections. |
| In lawsuits filed
on behalf of patients who suffered from ONJ,
or jaw death, after taking Fosamax, plaintiffs
allege that Merck was negligent in the manufacture,
testing and labeling of the drug. The suits
charge that Fosamax is defective and unsafe
in its formulation, and that Merck has misrepresented
the safety of the drug. |
| The complaints allege
that Merck failed to issue any warnings or
change its product literature to note the risks,
even after reports were published linking the
drug to ONJ and other drug manufacturers warned
physicians regarding the risk of ONJ with the
use of other brands of bisphosphonates. |
| The law in most states
provides several personal injury claims for
persons who have been seriously injured by
a prescription drug with dangerous, undisclosed
side effects. These claims include strict liability
for a defective product, breach of warranty,
negligence, and misrepresentation. |
| Damages sought against
pharmaceutical companies for drug side effects
and injuries include: |
- Physical pain and suffering, mental anguish
and physical impairment;
- Medical expenses associated with the
allegedly defective product; and
- Loss of earnings and/or earning capacity.
