Dangerous and Defective Medical Devices
|
Lieff Cabraser personal
injury attorneys have successfully represented
persons injured by defective medical devices nationwide,
including recipients of heart stents, hearing aids,
pacemakers, and breast, hip and knee implants.
For example, in December 2000, Sulzer Orthopedics, Inc., recalled almost 30,000 hip implants, followed in May 2001 with a notification of failures of a knee implant. In 2001 Sulzer announced an approximately $700 million settlement in which patients who needed surgery to replace their faulty implant would receive $57,500 in cash and stock.
Lieff Cabraser attorneys objected to the original settlement proposed by Sulzer as inadequate; subsequently, we played a leading role in negotiating a revised settlement with Sulzer valued at more than US $1 billion. In May 2002, the Court granted final approval to the revised settlement that provided patients who needed corrective surgery at least $200,000 in cash.

Legal Rights of the Injured
The law in most states provides individuals with legal
claims and the right to compensation for injuries they suffer as a result
of a defective product or the negligence of another. The injured person
may file a lawsuit seeking compensation for his or her pain and suffering,
medical expenses, lost past and future wages and punitive damages.
