Medtronic AneuRx Stent and Patient Deaths |
|
| On March 19, 2008,
the U.S. Food and Drug Administration ("FDA")
issued a public health notification concerning
the Medtronic AneuRx Stent Graft System.
The stent is inserted into patients in order
to prevent bulging blood vessels in the abdomen
from rupturing. Swollen blood vessels
can also be treated through conventional
surgery without a device. |
| The FDA
reported that a higher death rate
existed after five years among patients
treated for abdominal aortic aneurysms
with the Medtronic AneuRx Stent Graft
System than among those treated through
conventional surgery. |
| The FDA
estimates that 1.5 percent of patients
who have had AneuRx five years will
die from an aneurysm, well above
the 0.18 percent death rate in patients
who had surgery. |
| The law
in most states provides individuals
with legal claims and the right to
compensation for injuries they suffer
as a result of a defective product
or the negligence of another. |
| Damages
sought against manufacturers of an
allegedly defective medical device
typically include damages for: |
- Physical pain and suffering,
mental anguish and physical impairment;
- Medical expenses associated with
the allegedly defective product;
and
- Loss of earnings and/or earning
capacity.
|
| In the case
of the patient's death, the family
of the victim may file a wrongful
death action and seek damages. |
