On June 11, 2009, the Food and Drug Administration alerted patients to a recall of certain Medtronic Kappa and Sigma pacemakers. These devices may fail due to a separation of wires that connect the electronic circuit to other pacemaker components, such as the battery.
An estimated 15,200 Kappa pacemakers and 6,100 Sigma pacemakers, manufactured primarily between November 2000 and November 2002, are affected by this issue. The pacemakers subject to the recall are:
- Kappa Series 600/700/900
- Sigma Series 100/200/300
The FDA advises that patients with malfunctioning pacemakers may experience a return of symptoms associated with abnormal heart rate, such as fainting or lightheadedness. In rare cases, pacemaker-dependent patients may experience serious injury or even death.
Legal Rights of Injured Pacemaker Patients
The law in most states provides individuals with legal claims and the right to compensation for injuries they suffered due to a defective medical device.
In personal injury lawsuits against Medtronic for manufacturing an allegedly defective medical device, plaintiffs have typically sought damages for:
- Physical pain and suffering, mental anguish and physical impairment;
- Medical expenses associated with efforts to remedy the injuries as a result of the original surgery; and
- Loss of earnings and/or earning capacity.
In the case of a patient's death, the family of the victim may file a wrongful death action and seek damages.
