Ortho Evra Lawsuit: Claims Made Against Ortho
Evra Birth Control Patch |
|
| In personal injury lawsuits,
the national law firm of Lieff Cabraser Heimann & Bernstein,

serious side effects, including strokes and
pulmonary embolisms, after using the Ortho Evra
birth control patch. |
| The defendants in the
Ortho Evra lawsuits are Ortho-McNeil Pharmaceutical,
Inc., Johnson and Johnson, and Johnson and
Johnson Pharmaceutical Research and Development,
LLC f/k/a R.W. Johnson Pharmaceutical Research
Institute. These companies designed, researched,
manufactured, tested, advertised, promoted,
marketed, sold and distributed the Ortho Evra
Patch. |
| Plaintiffs charge that
Defendants failed to perform sufficient tests
on women using and/or wearing the birth control
patch during clinical trials. Instead, Defendants
relied heavily on safety and risk information
derived from studies of contraceptive pills,
stating, "[t]he following information
is derived primarily from studies of birth
control pills. Since Ortho Evra® contains
hormones similar to those found in birth control
pills, it is expected to be associated with
similar risks." |
| Plaintiffs charge that
safety information that applies to birth control
pills does not entirely and/or necessarily
apply to the Ortho Evra Patch, including the
risk of blood clots and strokes. Plaintiffs
specifically allege that: |
- Defendants knew or should have known that
the intake of hormones contained in Ortho Evra
through the Patch would result in a level
of estrogen (ethinyl estradiol) much higher
(approximately 60% higher) than the levels
associated with intake through the oral route,
such as with birth control pills.
- Defendants failed to conduct sufficient testing that would allow them to appropriately determine the safety, dangers, and risks associated with higher levels of hormones caused by intake of hormones contained in Ortho Evra through the Patch system versus an oral route such as through birth control pills.

embolism, venous thromboembolisms, blood
