Although MEGA Brands has twice recalled its popular Magnetix magnetic toys after numerous lawsuits, plaintiffs' attorneys said parents are still suing the company over swallowed magnets. Today, federal regulators will join the fray by making an announcement about the toys, which were blamed for the 2005 death of a 2-year-old. The most recent lawsuit involving Magnetix came after 9-year-old Logan Eberle received a Magnetix Magnetic Building Set in March 2006 as a birthday gift. About a year later his little brother, Braden, 5, underwent emergency surgery to remove magnets from his intestinal tract.
Doctors found two loose Magnetix-brand magnets that had connected and cut holes in Braden's colon area, which became infected, according to court documents. The complaint also alleged Braden continues to experience severe pain in his side. San Francisco attorney Fabrice Vincent, a partner with Lieff Cabraser Heimann & Bernstein, LLP, said his firm couldn't comment on the litigation but implied Friday that Lieff Cabraser was working on another similar case. "The toys are still out there, and there are still some defective parts, and that is still a real problem."
