FAMILY OF WELDER KILLED IN WORK FALL AT BROOKLYN SHIPYARDS FILES WRONGFUL DEATH ACTION

March 15, 2007, New York, NY -- Cira Bautista Vasquez and her son Victor Arturo Medina Bautista today filed a wrongful death action based on the death of Gumersindo Medina Duarte on January 23, 2007. Mr. Medina, age 36 and the husband of Ms. Bautista and father of Victor, died while working as a welder on a tanker barge in dry dock at GMD Shipyard Corporation in Brooklyn, New York. Mr. Medina fell off a hull access ladder, landing on the hull base sixty feet below, causing severe trauma to his head and torso. Mr. Medina struggled to survive but died within hours of the fall.
"The Complaint alleges that defendants were negligent in failing to provide Mr. Medina with any safety equipment or harness to hold him in case of a fall," commented Wendy R. Fleishman, counsel for plaintiffs. "This was the second recent senseless death at the shipyards. We want to see the working conditions change before another life is lost."
Representing plaintiffs are Wendy R. Fleishman of the New York office of Lieff Cabraser Heimann & Bernstein, LLP, Joseph S. Jaworski of the Jaworski Law Firm of Galveston, Texas, and Enrique Serna of Serna & Associates PLC of San Antonio, Texas.
The defendants in the action are dry dock owners FCE Industries, LTd. and GMD Shipyard Corporation, and Allied Transportation LLC, owner of the vessel on which Mr. Medina died.
