Chain
Saw Defects and Dangers |
|
| According to the
Consumer Product Safety Commission, there are
annually about 20 reported deaths and over 30,000
emergency-room-treated injuries associated with
chain saws. |
| A major risk factor
involved with chain saws is kickback, which
most often occurs when the saw chain accidentally
touches another object, such as a log, branch
or twig, which can throw the chain saw violently
back toward the operator. When saws are not
equipped with safety features, such as a low-kickback
chain, or when there is a defect with the saw
break or power switch, serious injuries or
death may occur. |

- In May 2003, Homelite Consumer Products Inc.
recalled about 6,900 chainsaws, which reportedly
could operate while the engine is at the "idle'
setting posing a risk of serious lacerations
or death to the operator and bystanders.
- In June 2001, Stihl Inc. recalled about 1,000
chain saws. A missing screw in the chain saws
reportedly could cause the chain brake to fail
to operate, presenting a serious risk of laceration
or amputation to consumers.
- In April 1997, Husqvarna Forest and Garden
Co. recalled about 277,000 chain saws. Heat
from the saw's muffler could reportedly melt
the saw's front hand guard if the removable
exhaust deflector is not attached properly.
The hand guard is designed to prevent contact
with the chain and can manually activate the
chain brake during a kickback. A damaged hand
guard exposes consumers to a risk of serious
laceration or amputation from the chain.

| The law in most states provides individuals with legal
claims and the right to compensation for injuries they suffer as a result
of a defective product or the negligence of another. The injured person
may file a lawsuit seeking compensation for his or her pain and suffering,
medical expenses, lost past and future wages and punitive damages. |
